The annual draft tax bills recently circulated for comment by the National Treasury and the South African Revenue Service contain contentious proposed amendments to the understatement penalty regime. The effect will allow the “bona fide inadvertent error” defence to avoid any USP only where the prejudice results in a “substantial understatement” — an objective test based on the calculated tax shortfall to SARS, writes Joon Chong.
